AGREEMENT TO TERMS
1.1. These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (you), and MMI – Munich Media Intelligence GmbH, located at Seestraße 10, 85757 Karlsfeld, Germany (we, us), concerning your access to and use of the https://shop.lumagic.tv website as well as any related applications (the Site).
USER REGISTRATION
2.1. Account Creation: To access Lumagic’s services, you must register and create an account. During the registration process, you will be required to provide accurate and complete information, including a valid email address, username, and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.2. By registering on our Site, you agree to provide us with your username, password, and email address. All stored data will be handled according to our Privacy Policy.
SERVICES
3.1. Through our Webshop (https://shop.lumagic.tv), users can purchase and download our proprietary Plugin for DaVinci Resolve. The Plugin is designed to extend the functionality of DaVinci Resolve and can only be used within compatible versions of the software, as specified on the product page.
3.2. License to Use: Upon purchase, you are granted a non-exclusive, non-transferable license to install and use the Plugin on multiple devices, provided it is used by only one person at a time. In the event of a change in your DaVinci Resolve account or hardware upgrade, you may transfer the license to the new system or account, provided the Plugin is uninstalled from the previous system.
3.3. User-Generated Content: If the Plugin allows you to create, modify, or export content, you retain ownership of your creations. However, you are solely responsible for ensuring that your use of the Plugin and any generated content complies with applicable laws and third-party rights.
3.4. Compatibility: The Plugin is only guaranteed to work with the DaVinci Resolve versions explicitly listed on the product page. We do not warrant compatibility with unsupported or future versions of DaVinci Resolve.

PAYMENT
4.1. Payment Processing: All purchases of our Plugin through the Webshop (https://shop.lumagic.tv) must be completed using the Stripe payment gateway. By providing your payment information, you authorize us to charge the specified amount to your chosen payment method.
4.2. All payments are processed securely by Stripe and are subject to Stripe's terms and conditions and privacy policy. We do not store or have access to your complete payment details.
4.3. Prices for our Plugin are listed on the product page in the Webshop and may be subject to change. Any applicable taxes or fees will be displayed before you complete your purchase.
4.4. Your purchase grants you access to the Plugin in accordance with the license terms described in Section 3. Refunds, if applicable, are handled in accordance with Section 6 (Warranty).
INTELLECTUAL PROPERTY RIGHTS
5.1. The Site, our proprietary algorithm, and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, and all Intellectual Property Rights related thereto, are the exclusive property of MMI – Munich Media Intelligence GmbH.
5.2. You are granted a limited, non-exclusive, non-transferable license to access and use the Website in accordance with these Terms.
5.3. You must not modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Website without our prior written consent.
WARRANTY
6.1. The consumer's right to exercise a warranty against product defects is governed by German law.
6.2. A defect is considered to exist in the following cases:
The Plugin cannot be installed on a system that meets the officially listed system requirements and supported DaVinci Resolve versions (as stated on the product page at https://shop.lumagic.tv).
The Plugin does not perform its core advertised functions as described in the product documentation.
Activation of the Plugin fails despite the use of valid license credentials provided after purchase.
6.3. The user is guaranteed a period of 14 days from the date of purchase to exercise the right to reclaim a refund, provided that the Plugin has not been used in violation of the license terms.
6.4. Refunds will be issued to the original payment method unless otherwise agreed with our support team.
6.5. The exercise of the right of complaint must occur through formal contact with the service provider via E-mail: support@lumagic.tv or via the contact form available on: https://shop.lumagic.tv/landing/support.
LIMITATION OF LIABILITY
7.1. To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Website or its services, even if we have been advised of the possibility of such damages.
TERMINATION
8.1. We may, at our sole discretion, suspend or terminate your access to the Website, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall remain in effect.
GOVERNING LAW AND JURISDICTION
9.1. These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Website shall be exclusively submitted to the competent courts in Munich, Bavaria – Germany.
CHANGES TO TERMS
10.1. We reserve the right to modify these Terms at any time. Any changes will be posted on the Website at least 14 days before they take effect. Your continued use of the Website and the services after any modifications constitute your acceptance of the revised Terms.
